Watchmaking Experience – Booking Terms and Conditions

1. These terms

1.1 What these terms cover. These terms and conditions (“Terms”) are the terms and conditions on which you agree to order and we agree to supply to you Watchmaking Experience Package which can be found and booked on our website at https://www.watchandrepair.com/book-watchmaking-experience/

1.2 Parties to these terms. These Terms apply between:

(a) Watch and Repair (“Watch and Repair”, “we”, “our” or “us”); and

(b) you, the customer (“you” or “your”). If you are booking on behalf of a group, “you” and “your” shall be deemed to include each member of that group.

1.3 Please read these terms carefully. These Terms tell you who we are, how we will provide Watchmaking Experience Package to you, how you and we may end the contract, what to do if there is a problem and other important information. Please read these Terms carefully and make sure you understand them before you submit a Watchmaking Experience Package order through us. By submitting an order for an Watchmaking Experience Package, you agree to be legally bound by these Terms.

1.4 How these terms will apply. Every time you purchase any Watchmaking Experience Package, the Terms in force at that time will be incorporated into the contract between us and will apply between you and us and by ordering any Watchmaking Experience Package you agree to be bound by these Terms. We may revise these terms and conditions from time to time. Please ensure that you read these Terms (along with any other terms referred to in clause 7.5) before placing an order for any Watchmaking Experience Package and make sure that you understand the Terms that will apply to your order.

2. Information about us and how to contact us

2.1 Who we are. We are Watch and Repair.

2.2 How to contact us. You can contact the Watch and Repair team by emailing us at contact@watchandrepair.com.

2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address you provided to us when you first placed an order for a Watchmaking Experience Package.

3. Watchmaking Experience Packages

3.1 Making an order. Once you have decided which Watchmaking Experience Package you wish to order, you can order a Watchmaking Experience Package online.

3.2 Acknowledgement of your order. When placing an order for a Watchmaking Experience Package, we may send you an email acknowledgement of your order, but this email does not necessarily confirm our acceptance of your order and we are entitled to refuse any order placed by you at any time up to acceptance of that order.

3.3 Confirmation of your order. Acceptance of any order only occurs at the time we receive the funds for the Watchmaking Experience Package which you have ordered (see clause 4 for further details). Once we have received your payment, we will send you an email confirmation stating that your order has been accepted. The contract between us will only be formed when we send you this confirmation.

3.4 If we cannot process your order. During the time delay between you placing, and us accepting, your order it is possible that the third party supplier’s services may become unavailable. We will advise you if this occurs and you will not be charged by us for the Watchmaking Experience Package you requested. If you have any questions about your order please contact us in accordance with clause 2.2 above.

3.5 Our responsibilities. We are responsible for arranging and concluding your order. We will collect and receive your payment for the Watchmaking Experience Package on behalf of the relevant third party supplier in accordance with clause 4 and this will discharge your debt to that third party supplier for the services you receive.

3.6 Minimum age requirements. Certain Watchmaking Experience Packages are only for customers satisfying a specified minimum age requirements. Where this is the case, we will inform you of such minimum age requirements at the time of placing your order. We will be unable to accept your order if you do not meet any specified minimum age requirement. Please do not attempt to order any Watchmaking Experience Packages on behalf of anyone who does not meet any specified minimum age requirement, as this may result in that person being unable to enjoy the Watchmaking Experience Package and a refund will not be provided in such circumstances.

4. Pricing

4.1 Where to find the price for Watchmaking Experience Packages. The price of the Watchmaking Experience Packages are located on our website. The price of Watchmaking Experience Package is the price in force at the date and time of your order, except where there is an inadvertent technical error. Any prices quoted on our website or otherwise provided in any applicable material from time to time are illustrative only, and we may change the price of the Watchmaking Experience Packages before you place an order.

4.2 Payment method: We can take payment for the Watchmaking Experience Packages by credit, debit card, PayPal, ApplePay and GooglePay using the details provided on the booking form.

4.3 What to do if you think an invoice is wrong. If you think any payment is wrong please contact the Watch and Repair team promptly in accordance with clause 2.2 to let us know.

5. Changes to the Watchmaking Experience Packages

5.1 Your right to change your order. Once you have purchased a Watchmaking Experience Package from us you will not be able to change your order. However, if you are unable to enjoy your Watchmaking Experience Package you may be able to transfer your package to another person. See clause 5.2 below for more details.

5.2 Transferring your order to another person where you are unable to enjoy your Watchmaking Experience Package. If you are unable to make use of your Watchmaking Experience Package, you may be able to transfer your Watchmaking Experience Package to a person who satisfies all the conditions applicable to the package. In order to do so, you must provide us with notice of your intention to transfer in good time before the date when your Watchmaking Experience Package is due to begin using the contact details in clause 2.2, and we will confirm to you whether such transfer is possible. In such circumstances, you will not be entitled to a refund and will remain liable for the price of your Watchmaking Experience Package.

5.3 Our right to make changes to these Terms and the Watchmaking Experience Packages. From time to time, we may revise these Terms and/or the Watchmaking Experience Packages we offer, for example:

(a) as a result of changes in relevant laws and regulatory requirements;

(b) to update the process you use to order such Watchmaking Experience Packages, including how we accept payment from you; or

(c) to update our list of preferred third party suppliers who we arrange to provide the services you order.

5.4 What happens if we make changes to these Terms and/or the Watchmaking Experience Packages after your order has been accepted. We will inform you in writing as soon as reasonably possible if we are required to make any changes to these Terms and/or the Watchmaking Experience Package you have ordered after we have accepted your order. We will provide you with details of any required changes to your Watchmaking Experience Package (including any change in price or substitutes we are able to offer you) and, where such changes negatively affect the supply of the relevant Watchmaking Experience Package to you, you have the option to cancel your order and receive a refund if you do not wish to accept such changes.

6. Your Registration Details

6.1 Use of your registration details. We will collect and process the personal identifiable information you provide to us on your registration form, this being your name, address, email address and telephone number:

(1) to arrange for the supply of the Watchmaking Experience Package to you and to record any such order you make;

(2) to process your payments/assist third parties completing transactions for the Watchmaking Experience Package;

(3) to update your records;

(4) to improve Watchmaking Experience Packages, keep Watchmaking Experience Packages safe and secure and ensure the content on Watchmaking Experience Packages are presented in the most effective manner;

(5) to contact you in relation to the supply of, or problem with, any Watchmaking Experience Packages ordered;

(6) to provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes; and

(7) to notify you about changes to your Watchmaking Experience Packages or these Terms.

In collecting your personal information, we as data controller shall ensure that it complies with its obligations under the Data Protection Act 1998 (or any subsequent legislation). Please see our Privacy Policy for further details about how we collect your personal information.

6.2 Your rights in relation to marketing. Any personal information you give to us will only be used by us in connection with any Watch and Repair activities and Watchmaking Experience Packages. We amay use your personal information to let you know about Watchmaking Experience Packages or Watch and Repair news that may be of interest if you agree for us to do. Even if you agree to us providing you with marketing information, you can always opt out at a later date by contacting us in accordance with clause 2.2 or writing to us at contact@watchandrepair.com. We will not give your personal data to any other third party.

6.3 Other important terms. Please also review our Privacy Policy.

6.4 What happens to my order details after you have enjoyed Watchmaking Experience Package (or cancelled in accordance with these Terms). Once all outstanding payments have been made, your payment details will be securely destroyed by our third party payment provider. We will retain your contact details and purchase history for as long as we are required by law or to deal with any possible disputes or as long as we reasonably require it for commercial reasons.

6.5 Your rights in relation to your personal information. You have the right to a copy of the personal information we hold about you and to have any inaccuracies corrected. Please send requests to contact@watchandrepair.com.

6.6 Complaints in relation to your personal information. If you have a complaint in relation to the use or storage of your personal information, please contact Watch and Repair team by emailing us at contact@watchandrepair.com.

7. Cancelling your Watchmaking Experience Package

7.1 Please note that for Watchmaking Experience Package, you will not have a right to a refund in the case of cancellation once your order has been accepted save for as set out in clause 5.2 above. We may in exceptional circumstances, offer a refund to you, however this will be entirely at our discretion and we reserve the right to determine how much to refund you for your purchase of the Watchmaking Experience Package in this instance.

7.2 Cancelling the Watchmaking Experience Package. To cancel your Watchmaking Experience Package in accordance with these Terms, you can contact us directly using the contact details at clause 8.2.

8. If there is a complaint about Watchmaking Experience Package

8.1 How to tell us about complaints. We care about your experience and want to ensure we maintain the highest standards possible. If you are not happy with the service you have received from us, we would like the chance to put it right. If you have any complaints about Watchmaking Experience Packages or any of our third party suppliers, our internal complaint handling procedures are in place to deal with your concerns when things go wrong.

8.3 Summary of your legal rights. We are under a legal duty to supply Watchmaking Experience Packages in conformity with this contract. If you are a consumer, advice about your legal rights is available from your local Citizens’ Advice Bureau. For detailed information, please visit the Citizens Advice website www.adviceguide.org.uk or call 03454 04 05 06. Nothing in these terms and conditions will affect these legal rights.

9. Our responsibility for loss or damage suffered by you

9.1 We will use reasonable endeavours to ensure that all prices, descriptions, images and other information published on our website from time to time are accurate at the date of publication, but there may be circumstances in which errors or omissions may occur, including regarding the description of the products, the price, promotions, offers and the availability of the Watchmaking Experience Packages. Consequently, we do not warrant the accuracy or completeness of any information provided by us and, to the maximum extent permitted by law, we provide you with Watchmaking Experience Packages on the basis that we exclude all representations and disclaim all express and implied warranties, conditions and other terms of any kind which, but for these Terms might have effect in relation to the Watchmaking Experience Packages. These Terms (and any document referred to within these Terms) constitute the entire agreement between you and us.

9.2 We will not be liable to you, whether in contract, tort or otherwise for any:

(a) indirect or consequential loss or damage;

(b) any economic loss, including loss of revenue, profit, business, data or anticipated savings; and/or

(c) loss of reputation or goodwill;

that may be suffered or claimed by you which arises in conjunction with the use, inability to use or the supply of the Watchmaking Experience Packages. If we are liable to you for any reason, our liability will be limited to the amount paid by you for the Watchmaking Experience Packages.

9.3 If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable or that is caused by our third party suppliers. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us when you ordered the Watchmaking Experience Package.

9.4 Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any liability to the extent that it cannot be excluded or limited under applicable law or regulation.

9.5 The limitations and exclusions in this clause do not affect your non-excludable statutory rights and only apply to the extent permitted by applicable law.

10. Other important terms

10.1 We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation. We will tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

10.2 You need our consent to transfer your rights to someone else. You may not assign any rights and/or transfer, subcontract or delegate any obligations under these Terms unless you have our consent.

10.3 Nobody else has any rights under this contract. This contract is between you and us. These Terms do not confer any rights on any person or party pursuant to the Contracts (Rights of Third Parties) Act 1999.

10.4 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

10.5 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the Watchmaking Experience Packages, we can still require you to make the payment at a later date.

10.6 Which laws apply to this contract and where you may bring legal proceedings. These Terms and any dispute or claim arising out of or in connection with them or their subject matter, whether of a contractual or non-contractual nature shall be governed by and construed in accordance with the laws of England. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute regarding these Terms and any and all dealings between us and you.
